Terms of Service

IMPORTANT: Please read these Terms of Service carefully before using Practiq. By registering for Practiq Solo, using a trial, promotional, or invite-only program, or subscribing to Practiq, you agree to be bound by these terms.

1. ABOUT PRACTIQ

Practiq ("we", "us", "our") is a practice management software platform operated by ELF Consulting, Eureka, California. Practiq provides appointment booking, patient management, clinical documentation, billing, and related tools for independent health practitioners ("you", "your", "Subscriber").

2. ELIGIBILITY

You must be a licensed or registered health practitioner or an authorized representative of a health practice to use Practiq. By registering, you confirm that you are at least 18 years of age and have the legal authority to enter into this agreement.

3. FREE SOLO PLAN AND OTHER OFFERS

3.1 Solo Plan Ordinary public self-service registration starts with Practiq Solo, a free plan intended as a usable starting point for a practice. Solo is free to keep using unless access is closed, suspended, or terminated under these Terms.

3.2 No Credit Card Required No credit card is required to start with Solo.

3.3 Your Data on Solo Any data you enter into Practiq — including patient records, appointments, and clinical notes — is your data. You may export your data while your account is active and you have access to the export tools.

3.4 Other Trials or Programs Practiq may offer separate trials, promotional access, or invite-only programs under separately stated terms. Those offers do not change the ordinary Solo plan unless expressly stated.

3.5 Account Closure and Retention Account closure, suspension, termination, data retention, and deletion are governed by these Terms, the Privacy Policy, applicable agreements, customer responsibilities, and legal or operational requirements. Solo data is not automatically deleted because Solo is a free plan.

4. SUBSCRIPTIONS AND BILLING

4.1 Monthly Billing Paid subscriptions are billed monthly in advance via Stripe.

4.2 Tiers

4.3 Feature Scope by Tier Solo is intended as a useful basic tier. AI drafting and advanced follow-up tools are available in Plus and higher tiers.

4.4 Auto-Renewal Paid subscriptions renew automatically each month unless cancelled.

4.5 Cancellation You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.

4.6 Price Changes We reserve the right to change pricing with 30 days written notice to your registered email address.

5. YOUR DATA

5.1 Ownership All data you enter into Practiq — including patient records, appointments, clinical notes, and billing information — belongs to you. We do not claim ownership of your data.

5.2 Your Responsibility You are responsible for ensuring that your use of Practiq complies with all applicable laws, including those governing patient privacy and health records in your jurisdiction.

5.3 Data Export You may export your data at any time while your account is active.

5.4 Data Retention on Cancellation or Closure If you cancel a paid subscription, close an account, or lose access to a non-Solo offer, retention and deletion are handled according to these Terms, the Privacy Policy, applicable agreements, customer responsibilities, and legal or operational requirements. You are encouraged to export records you need before closing an account or ending a paid subscription.

5.5 Backups We maintain regular backups of your data. However, you are encouraged to export your own backups regularly.

6. PATIENT DATA AND HIPAA

6.1 You are the Covered Entity Practiq is a technology platform. You, as the health practitioner, are the Covered Entity responsible for compliance with HIPAA and any applicable state health privacy laws.

6.2 We are a Business Associate Practiq acts as a Business Associate under HIPAA. We handle patient data only as directed by you and only to provide the services described herein.

6.3 Business Associate Agreements Formal HIPAA Business Associate Agreements (BAA) are available upon request for Clinic subscribers. Please contact us at alfred.laggner@gmail.com.

6.4 Your Consent You agree not to enter any patient data into Practiq that you are not legally authorized to collect and store.

8. AVAILABILITY AND SUPPORT

8.1 Uptime We aim for 99% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.

8.2 Support Support is provided by email at alfred.laggner@gmail.com. We aim to respond within 1 business day.

8.3 Liability We are not liable for any loss resulting from service interruptions.

9. LIMITATION OF LIABILITY

9.1 Not Medical Advice Practiq is a practice management tool. It does not provide medical advice and is not a medical device.

9.2 Your Responsibility You are solely responsible for all clinical decisions made using information in Practiq. We accept no liability for clinical outcomes.

9.3 Liability Cap To the maximum extent permitted by law, our total liability to you for any claim arising from your use of Practiq shall not exceed the amount you paid us in the 3 months preceding the claim.

9.4 No Consequential Damages We are not liable for indirect, incidental, special, or consequential damages.

10. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of Practiq after changes take effect constitutes acceptance of the new terms.

11. GOVERNING LAW

These terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts of Humboldt County, California.
